"OLIVIERS&CO WITH YOU IN VACATION"
Article 1: Organizing Company
The company OLIVIERS&CO Boutiques, SARL (hereinafter referred to as the "Organizing Company"), registered in the Trade and Companies Register under the number 494.894.142, whose registered office is ZA de Pitaugier, Mane (04300),
organizes between the 06/07/2022 and the 29/08/2022 a contest without obligation of purchase entitled
"Oliviers&Co with you in vacation" (hereinafter "the Game").
Article 2: Game media
The Game will take place from 06/07/2022 to 29/08/2022 at 23:59 and will be announced on
- The website oliviers-co.com. (the "Site");
- Digital media and social networks;
- E-mailings from the database of the Organizing Body.
Article 3 : Conditions of participation
The Contest is open to any natural person of legal age (on the date of participation in the Contest) residing in metropolitan France (including Corsica) who has an e-mail address, an account on the social networks Facebook and/or Instagram and an Internet connection, with the exception of members of the staff of the Organizing Body, of its service providers, of the points of sale and their respective families, and of any entity having participated directly or indirectly in the design, organization, realization and/or management of the Contest
Article 4: Prizes
4.1 Definition of the prize
To be won at the end of the Contest: One (1) prize:
1 stay of 2 days and 1 night for 2 people in the Alpes de Haute-Provence, with a commercial value of €900 including tax.
The prize includes: transportation to and from the train station closest to the winner's home to the Aix en Provence TGV station, a night at the Charembeau Hotel (Forcalquier) in a double room with breakfast, tourist tax, a visit to the orchards and mill of a partner olive oil producer and a tasting of the farm's products, the rental of a car in eco category (unlimited mileage and with insurance included) from the station of Aix en Provence TGV, the dinner excluding alcoholic drinks at the restaurant l'Auberge du Bois (Niozelles).
The detailed program will be determined according to the winner's choices, within the limit of the total value of the prize.
The prize does not include: personal expenses, transportation from home to the departure station and back, gasoline and toll fees on site.
Period to use the prize: between September 15 and November 01, 2022 or between March 01 and November 01, 2023, depending on the availability of partner service providers.
The winner of the prize will be informed of his or her win via private message on the instagram and/or facebook account, which posted the photo designated as the winner, within one week from the date of the final vote and its announcement on the facebook account Oliviers & Co Officiel and instagram oliviersandco.france.
The prizes are not modifiable, not exchangeable and not refundable.
If the winner wishes additional services not included in the description of the prize or if the related services chosen by the winner correspond to a commercial value higher than the one initially planned by the Organizing Company, the additional cost will be at the exclusive personal charge of the winner.
The value of the prizes is determined at the time of drafting these rules and cannot be contested as to its evaluation.
These prizes may not be the subject of a request for financial consideration, exchange or return, for any reason whatsoever.
The Organizing Body reserves the right, if circumstances so require, to substitute, at any time, for the prizes, prizes of equivalent commercial unit value and characteristics.
Article 5: Terms and conditions and determination of winners
To participate in the Game, the interested person must simply:
- Post between 06/07/2022 and 29/08/2022 23h59, from his/her instagram or facebook account, a photo representing a table set up in the style of a summer meal, and which includes at least 1 (one) product of the Oliviers & Co brand
- Identify the Oliviers & Co Official facebook account or instagram oliviersando.france, and the # tabledeteoliviersandco
- Liked at least one (1) of the posts on instagram oliviersandco.france and/or facebook Oliviers & Co Officiel related to this contest announcement
Without these 3 conditions, the participation will not be taken into account.
A pre-selection of the 3 most convincing photos will be made by a vote within the Oliviers & Co team between 29/08/2022 and 30/08/2022.
Three (3) finalists will be announced on 31/08/2022 on Oliviers & Co social networks
A final vote that will designate THE winning photo will be organized from the Facebook and Instagram accounts of the Organizing Company between 29/08/2022 and 31/08/2022 and will allow its community to elect the winning photo.
The announcement of the winner will take place on 31/08/2022.
The winner of the prize will be informed of his or her win via private message on the Instagram and/or Facebook account that posted the winning photo, within one week from the date of the final vote and its announcement on the Facebook account Oliviers & Co Officiel and Instagram oliviersandco.france.
Article 6 : Rules
Participation to the Game implies the full acceptance of the present rules.
No request will be answered (by e-mail or by phone) concerning the interpretation or the application of the rules, concerning the modalities and mechanisms of the Game.
Article 7: Non-reimbursement of the costs of participation and consultation of the rules
The costs of participating in the Contest and of consulting the rules, whatever they may be (internet connection costs, etc.), shall not be reimbursed by the Organizing Body.
Article 8: Limit of liability
8.1. The Organizing Body shall not be held responsible for problems inherent in the Internet connection, telephone communication or the poor delivery of mail or any other problem that is not attributable to it and that occurs during the Contest.
It is therefore the responsibility of each participant to take all appropriate measures to protect his/her equipment and the data stored on his/her equipment (computer and telephone) against any attack. Participation in the Contest implies knowledge and acceptance of the characteristics and limits of the Internet network, the lack of protection of certain data against possible misappropriation or piracy by third parties and the risks of contamination by any viruses circulating on the network, or any other hazard related to postal services.
8.2. If a winner's contact information cannot be used or if the winner cannot be identified by name, postal address or e-mail address, it is not the responsibility of the Organizing Body to make further inquiries in order to find the unavailable winner, who will receive neither his or her prize nor any compensation or indemnity.
8.3. The winners will be contacted by private message on facebook and/or instagram.
In the event that the Organizing Body does not manage to contact the winner by private message on his/her Facebook and/or Instagram account (the account that posted the winning photo) after two attempts, the winner not having claimed his/her prize within one (1) month following the date of the first message notifying him/her of his/her prize, he/she shall be considered to have purely and simply renounced his/her prize. The prize will not be awarded and may not be claimed at a later date under any circumstances. It shall remain the property of the Organizing Body and may be reallocated to a substitute or used as part of a subsequent operation, if the nature of the prize so permits, and without the Organizing Body being held liable in any way.
8.6. In the event of the winner's express waiver of his or her prize, the prize may in no case be claimed at a later date.
Article 9: Disqualification
Participants authorize all verifications concerning their identity, age, e-mail address, and address within the framework of the Game. Any participation that does not comply with these rules, that is incomplete or with incorrect contact information will be considered null and void. Any fraud or attempt at fraud, use of robots or any other similar process that makes it possible to play the Game mechanically and/or to increase one's chances of winning by any means or otherwise is prohibited.
The Organizing Body may thus exclude, suspend and/or permanently cancel the participation of one or more participants in the event of the observation of suspicious behavior consisting in particular of the implementation of an automated response system, the connection of several people and different computer stations from the same participation profile, an unusual rate of winnings, an attempt to break into the organizers' servers, a multiplication of accounts, etc. The Organizing Body may not award the prizes to the participants concerned, based on the information in its possession, and/or prosecute the perpetrators of such fraud before the competent courts.
The Organizing Body may also cancel all or part of the Game if it appears that fraud has occurred in any form whatsoever, in particular in a computerized manner in the context of participation in the Game and/or the determination of the winners. In the event of a sanction or claim, participants must prove that they have behaved in accordance with these rules. The liability of the Organizing Body may not be incurred in this regard.
Article 10: Force majeure
The Organizing Body shall not incur any liability if, in the event of force majeure or events beyond its control or
events beyond its control or if circumstances so require, it should cancel this Contest, shorten, extend, postpone, suspend or modify the conditions thereof, and it shall not be held liable in this regard.
In any case, it reserves the right to extend the participation period.
Article 11: Exemption from liability
The Organizing Body shall not be held responsible for any defect or malfunction of the prizes, which are the sole responsibility of the service providers. It declines all responsibility for any incidents or accidents that may occur to the winner(s) during the use and/or enjoyment of the prizes.
Article 12: Authorization to use the winners' names, addresses and images
Subject to having obtained the express authorization of the participant of legal age, the Organizing Body may use for advertising purposes the first names, surnames, addresses and photographs of the participants, without this conferring upon them any right to remuneration or any advantage whatsoever other than the award of their prize. Participation in the Game implies acceptance by the participant that his name or pseudonym may be cited on the Facebook and Instagram pages of the Organizing Body for the proper conduct of the Game, during the announcement of the 3 finalists or the winner, if he were to be one of them.
Article 13: Intellectual property rights and copyrights
In accordance with the laws governing intellectual property rights and copyright, the use of all or part of the elements that are the subject of an intellectual property right or protected by copyright reproduced in the context of this Contest, including the brands that appear therein, is strictly prohibited, except with the express and prior authorization of the Organizing Body.
The Organizing Body may, in the context of the Contest, share any photo posted by the Participant on his/her own Facebook and Instagram account, without this conferring any right to remuneration or any benefit whatsoever other than the awarding of their prize in the event that they win.
Article 14: Applicable law and disputes
The Game is subject to French law.
Any dispute concerning the interpretation of the rules and/or cases not provided for in these rules will be settled out of court. Failing that, it will be submitted to the jurisdictions of the Court of Appeal of Paris.
